CONSTITUTIONAL AMENDMENT PROPOSALS:
SJR0127. Amends the constitution by adding to Article I: "Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion." DATE: 03/09/06. COMMENT: This amendment addresses an egregious Tennessee Supreme Court decision (September, 2000) in Planned Parenthood of Middle Tennessee vs Sundquist, in which the court ruled that there is a fundamental right to abortion in the state constitution. This ruling stripped away virtually all of Tennessee's commonsense abortion oversight laws-- laws present in virtually all other states and permitted by the U.S. Supreme Counrt, as being both constitutional and permissible under its 1973 decisions in Roe vs Wade and Doe vs Bolton. This amendment would permit the General Assembly-- not the Tennessee Supreme Court-- to decide whether abortion clinics should employ safeguards for abortion-seeking women in abortion clinics. Before amending the constitution, SJR0127 must be adopted by the House of Representatives by simple majority in the 1o4th General Assembly (2006); then, the resolution must lie over an election cycle (November of 2006); then, a resolution of the same wording must be adopted by a two-thirds majority in the 105th General Assembly (2007 or 2008); and, then, voters must ratify the amendment by a simple majority in the next gubernatorial election (November of 2010). ACTION ON AD HOC COMMITTEE REPORT-- SPECIAL ELECTION IN DISTRICT 29. ABSTRACT: Adopts ad hoc committee report, finding that the special election to replace Senator John Ford is incurably flawed and the election should be voided. DATE: 04/19/06. SENATE VOTE: 26/6/0. MY VOTE: Aye. COMMENT: Senator John Ford was the state senator from District 29 (Shelby County) for many years. He was arrested and charged in Operation Tennessee Waltz in May of 2005; he resigned promptly thereafter. A special election was held in the District to replace him. His sister, Ophelia Ford, was credited with having 13 more votes than her opponent, Terry Rowland. The election was challenged. An ad hoc Senate committee was appointed. A significant number of irregularities were found (such as, votes from dead people and people residing outside of the district). Two federal court hearings followed. The Senate committee found that there were so many irreularities in a close election, that it would be impossible to know with certainty which candidate won. The election was voided, as is permissible under the state's constitution. Ophelia Ford was dismissed from her Senate seat on April 19. The Shelby County legislative body has two options: (1) appoint an interim senator (which could be Ophelia Ford), or (2) do nothing. An election for state senator will be held in this district in November of 2006.
